A Practical Guide to REALTOR®/HBA Builder Relations

This brochure is designed to outline the basic procedures that will enable the REALTOR® and the HBA Builder to work in partnership under common guidelines from introduction and registration to contract closing for the benefit of all parties.

Your Client Wants a New Home… Now What?
1.	Policies vary from HBA Builder to HBA Builder.  You must ALWAYS contact HBA Builders directly and become familiar with their registration policies prior to your visit.  This is the first step to help protect your monetary interest with an HBA Builder.
2.	The REALTOR® must formally register the Client with the HBA Builder, following the HBA Builder’s appropriate registration procedures.
3.	If the REALTOR® cannot accompany the Client on the initial visit with the HBA Builder, the REALTOR® must notify the HBA Builder prior to the visit and inquire as to the HBA Builder’s alternative registration policy (if there is one).
4.	Should the Client return to the HBA Builder alone and enter into a purchase agreement, it is expected that the HBA Builder will honor payment of fees as outlined in that HBA Builder’s registration agreement.  The HBA Builder should notify the REALTOR® of continued interest from any registered Client. 
5.	Should the Client return to the HBA Builder accompanied by a different REALTOR® and enter into an acceptable purchase agreement, the original REALTOR® should not expect the HBA Builder to be liable for payment of any fees or commissions.  All disputes between REALTORS® on such matters should be handled through the St. Louis Association of REALTORS® Arbitration process. 

Responsibilities and Expectations

The REALTOR®
REALTORS® are real estate professionals who are members of the national, state, and local associations of REALTORS®, adhering to a strict code of ethics.

- REALTORS® should acquaint the prospective Client with the value of their representation (assuming a Buyer’s Agency relationship exists) and should stress the importance of their participation at the first contact with the HBA Builder.
- REALTORS® should acquaint themselves with the HBA Builder’s products, warranty programs, service procedures, etc.
- REALTORS® should be familiar with the HBA Builder’s policies, procedures and paperwork and should educate the prospective Client about what to expect in the building/acquisition process.
- REALTORS® should exercise diligent efforts to assure they are introducing qualified prospects to the HBA Builders.
- The HBA Builder and the REALTOR® should have an understanding of the extent of the REALTOR’S® involvement throughout the building/acquisition process.  
- REALTORS® should strive to maintain open communication throughout the building/acquisition process.
- REALTORS® should provide the HBA Builders with feedback as to why registered prospective Clients failed to buy.
- REALTORS® should ALWAYS comply with Missouri Real Estate Law and Missouri Real Estate Commission Rules and Regulations, including, but not limited to, required agency relationship disclosures.

The HBA Builder
HBA Builders are construction professionals who are members of the national, state, and local builder associations, adhering to national and local association codes of ethics.  

- HBA Builders should inform REALTORS® of company registration policies.
- HBA Builders should notify REALTORS® immediately if there is a problem with the registration method used to introduce the Client.
- HBA Builders should honor registration and fee agreements.
- HBA Builders should understand that, subject to Agency relationships and licensing mandates, REALTORS® may need to take appropriate steps in either offering additional information to a prospective Client OR in retaining privileged information about the Client. 
- HBA Builders should promote the value of the REALTOR’S® participation in the building/acquisition process to prospective Clients introduced by REALTORS® 
- HBA Builders should expect the REALTOR®, where buyer representation exists, to exercise reasonable care and diligence in protecting the interest of the Buyer.
- HBA Builders should strive to maintain open communication throughout the building/acquisition process.

The purpose of this brochure is to promote high standards of conduct in new home sales transactions and to clearly identify the important roles of the REALTOR®, HBA Builder and the Client in a new home purchase.
